TERMS AND CONDITIONS OF SALE
1. General
These Standard Terms and Conditions of Sale ("Terms") apply to all sales of merchandise ("Products") by Euro Union ("Seller") through the website www.eurounion.ca ("Website") to customers located in Canada. By placing an order for Products, the customer ("Buyer") agrees to be bound by these Terms. These Terms may be updated by the Seller at any time without prior notice to the Buyer. The latest version of the Terms will always be available on the Website.
2. Orders and Acceptance
All orders placed by the Buyer on the Website are subject to acceptance by the Seller. The Seller reserves the right to refuse, cancel, or limit any order at its sole discretion, including but not limited to orders that contain incorrect prices, errors in product descriptions, or orders placed by a Buyer with a history of non-payment or violation of these Terms.
3. Prices and Payment
Prices for the Products are quoted in Canadian Dollars (CAD) and are subject to change at any time without prior notice. The Buyer shall pay for the Products and any applicable taxes and shipping fees at the time of placing an order. The Seller accepts all major credit cards and other payment methods as specified on the Website.
4. Shipping and Delivery
The Seller will ship the Products to the address provided by the Buyer within a reasonable time after the order is accepted. The Seller is not responsible for any delays or non-delivery of the Products due to incorrect or incomplete address information provided by the Buyer, customs clearance issues, or any other circumstances beyond the Seller's control.
5. Returns and Refunds
The Buyer may return the Products within 30 days from the date of delivery, provided that the Products are in their original condition, unused, unworn, and with all original tags and packaging. The Buyer must contact the Seller for a return authorization before returning any Products. The Buyer is responsible for return shipping costs. Refunds will be issued within 14 days of the Seller receiving and inspecting the returned Products.
6. Warranty
The Seller warrants that the Products will be free from material defects in workmanship and materials for a period of one year from the date of delivery. In the event of a defect, the Buyer's sole remedy is the repair, replacement, or refund of the defective Product, at the Seller's discretion.
7. Limitation of Liability
In no event shall the Seller be liable for any indirect, incidental, consequential, or special damages, including but not limited to lost profits or revenue, arising out of or in connection with the sale, delivery, use, or performance of the Products, even if the Seller has been advised of the possibility of such damages.
8. Intellectual Property
The Buyer acknowledges that the merchandise is subject to the intellectual property rights of the respective media owners. The Buyer agrees not to engage in any unauthorized use, reproduction, or distribution of the merchandise or any associated intellectual property.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Province of Newfoundland & Labrador, Canada, without regard to its conflict of law provisions. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the Province of Newfoundland & Labrador, Canada.
10. Entire Agreement
These Terms, together with any other policies or terms posted on the Website, constitute the entire agreement between the Buyer and the Seller concerning the sale of the Products and supersede any prior or contemporaneous agreements, understandings, or representations.
